Cum quis sub aliqua condicione fuerit stipulatus, licet ante condicionem decesserit, postea existente condicione, heres eius agere potest. idem est et a promissoris parte. Qui hoc anno aut hoc mense dari stipulatus sit, nisi omnibus partibus praeteritis anni vel mensis non recte petet. Si fundum dari stipuleris vel hominem, non poteris continuo agere, nisi tantum spatii praeterierit quo traditio fieri possit.
